That\u2019s what fixed rate means, right? Well, some households around New Jersey were surprised to find out recently that some energy providers didn\u2019t see it that way. Some unscrupulous third-party suppliers were tacking on extra charges and hiking up energy costs, preventing their customers from <\/span><a href=\"https:\/\/www.njenergyratings.com\/resources\/10-quick-energy-savings-tips\"><span style=\"font-weight: 400;\">saving money on their energy bills<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Why Were Electricity Companies Charging More?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Within every fixed term contract there are a number of clauses that enable the supplier to vary the costs of energy. This typically comes from regulatory changes or if market upheaval makes it impossible to supply energy at the agreed cost. However, some companies exploited a minor change in the law as the <\/span><a href=\"http:\/\/www.energychoicematters.com\/stories\/20190130aa.html\"><span style=\"font-weight: 400;\">basis for introducing extra fees<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What Changes Were Made To The Law?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The law which prompted this was <\/span><a href=\"https:\/\/legiscan.com\/NJ\/bill\/A3723\/2018\"><span style=\"font-weight: 400;\">New Jersey Assembly Bill 3723<\/span><\/a><span style=\"font-weight: 400;\">, an act which <\/span><i><span style=\"font-weight: 400;\">\u201ce<\/span><\/i><i><span style=\"font-weight: 400;\">stablishes and modifies clean energy and energy efficiency programs; modifies State&#8217;s solar renewable energy portfolio standards\u201d<\/span><\/i><span style=\"font-weight: 400;\">. Nothing in this was designed to alter how third party energy suppliers work, nor was it intended to do so. However, some businesses claimed that rule muddied the waters somewhat. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to these retail suppliers, the new rules made it unclear as to how energy contracts should be treated. Specifically, how contracts from <\/span><a href=\"https:\/\/www.state.nj.us\/bpu\/about\/divisions\/energy\/bgs.html\"><span style=\"font-weight: 400;\">Basic Generation Service customers<\/span><\/a><span style=\"font-weight: 400;\"> versus competitive retail supply contracts should be handled. Some <a href=\"https:\/\/www.njenergyratings.com\/resources\/types-of-electricity-contracts-in-new-jersey\">New Jersey electricity suppliers<\/a>\u00a0took advantage of the vague language by by either increasing their fixed rate prices or adding an additional charge to their monthly bill. As a result,\u00a0<\/span><span style=\"font-weight: 400;\">the NJ BPU issued \u201cCease &amp; Desist\u201d notices to all suppliers, warning such practices would not be tolerated. All businesses which had been found making these charges were ordered to refund them, as this was in <\/span><a href=\"https:\/\/www.njenergyratings.com\/resources\/your-consumer-rights\"><span style=\"font-weight: 400;\">contravention of their customer\u2019s consumer rights<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What If I\u2019ve Been Over Charged?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The BPU makes it very clear that energy suppliers cannot use this law change to levy additional costs.
